What is Divorce?


Divorce is the undoing of the juridical formalities and responsibilities of marriages. It is the way of separation between couples legally in a court. Personal clashes, sexual incompatibility between spouses. In a simple way, divorce is the legal separation of men and wife under a judge.

Let's find out about each of them in brief:

1. Fault and no-fault divorce: 

Decades ago, it was made compulsory in all countries, that divorce is applicable if it is proved by one that the other has had performed an act inappropriate to the marriage. This was the main point kept, to get a divorce in California, United States, Canada and other Western countries.

2. Uncontested Divorce: 

In an Uncontested Divorce, both husband and wife come together and distribute the property, children and other belongings and then file the necessary paperwork. In Uncontested Divorce, there is no trial, and also no visit to court is required if both couples agree to the terms mutually. This divorce is considered as most accessible and also takes less money to be completed. It has been estimated that more than 92 % of divorces in the United States are Uncontested.

3. Contested Divorce: 

This is one of the worst types of divorce, which brings lots of disputes and fights. When the property distribution is not as per the requirement of any of the couple, then the matter is taken to court, where the judge decides and distributes the property. This procedure is known as Contested Divorce. Couples have to go through agreement colloquies and discussions to work and resolve their issues.

4. Collaborative Divorce: 

This type of divorces requires a lawyer, but not in the court. Both bodies can hire a lawyer for themselves and can have a general meet, where all negotiations and property dealings will be done and with each other mutual consent.

5. Summary Divorce: 

Such divorce is for those who have a short-term marriage period, say, less than five years. In such case, there are chances of having no children and less property. Also, it requires less paperwork and no lawyer.

Divorce or dissolution of marriage is the last stage of marriage. The statistics of divorce in various countries irrespective of age provides an exciting picture of divorce statistics.

It has been seen that around 50 % of marriages in the United  States, end in divorce. This percentage is quite high if we compare it with other countries. The highest percentage of women getting a divorce in U.S. are under the age of 20, and the highest percentage of men getting a divorce in U.S are under the age gap of 20 to 24 years.
